ATLANTA (March 20, 2013) – Prominent Georgia psychiatrist Randy Warner this week filed an amended lawsuit against Tanner Medical Center alleging racketeering, fraudulent billing, wire fraud, invasion of privacy and the infliction of emotional distress among other misdeeds.  The lawsuit, filed in Superior Court of Carroll County by attorney Gary Bunch, seeks monetary damages in excess of $8 million.

The lawsuit alleges that Tanner Medical Center, a subsidiary of non-profit Tanner Health System, engaged in a pattern of unethical and illegal activities aimed at keeping Dr. Warner as a captive physician in order to maximize profits –at the expense of quality care at its Willowbrooke behavioral care facility.

According to the lawsuit, TMC’s Willowbrooke facility is a victim of gross mismanagement, high turnover and understaffing which has put patients at risk.  The facility ignored Dr. Warner’s complaints, mishandled a sexual assault involving a minor, violated standards of care, manipulated patient discharges to increase profits and maliciously manipulated its own review process.

“Putting patients before profit incurs the wrath of Tanner Medical Center,” said Dr. Warner.  “They have driven out a number of excellent physicians with their bullying ways, but I refuse to play ball.”

The six-count lawsuit and background materials (more than 100 pages in length) illustrate a shocking and deliberate pattern by TMC to besmirch Dr. Warner.  His phone was monitored and financial and personal information shared while current and future business relationships were tampered with.  The lawsuit also alleges that TMC engaged in repeated and continuous wire and mail fraud by electronically billing third party payers for services Dr. Warner provided to dozens of patients.  TMC also placed Dr. Warner on focused review without any legitimate reason and until they could replace him, in violation of its bylaws and as part of its continued efforts to keep Dr. Warner “chained” to Willowbrooke.
